Who we are. These Terms of Use (“Terms”) govern your access to and use of the website armsaroundtheworld.music and related pages (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) Our Services

The Site provides information about the band arms around the world, links to listen to music and videos, tour and merch information, and email signup. Some content or purchases may be fulfilled through third-party services.

The Site is intended for users 18 years or older.

2) Intellectual Property

All music, audio, video, text, images, logos, and artwork on the Site are owned by us or our licensors and are protected by law. You may view the Site for personal, non-commercial use only. Do not copy, reproduce, distribute, publicly display, or make derivative works without our prior written permission.

3) Third-Party Services & Links

We may link to or embed third-party services (e.g., YouTube, Spotify, Feature.fm, Shopify/Squarespace stores). Those services are governed by their own terms and privacy policies, and we are not responsible for their content, policies, or practices.

4) Acceptable Use

You agree not to: (a) interfere with the Site’s operation; (b) attempt to access non-public areas; (c) copy, scrape, or harvest content or data; (d) upload malware or attempt to bypass security; or (e) use the Site in violation of applicable law.

No user postings. The Site does not offer public user forums or comment areas. If you send us ideas or feedback, you grant us a non-exclusive, royalty-free right to use them.

5) Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Notice. By using the Site, you consent to processing as described there.

6) Changes, Availability

We may update or discontinue any part of the Site at any time without notice. We do not guarantee uninterrupted or error-free operation.

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). To the fullest extent permitted by law, our total liability arising out of or related to the Site will not exceed USD $100. We will not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits or data).

9) Indemnity

You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

10) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Washington (without regard to conflicts rules). Before filing, the parties will attempt to resolve any dispute informally for 30 days after written notice.

If unresolved, disputes will be finally resolved by binding arbitration under the AAA Consumer Rules. Venue will be King County, Washington (or video/teleconference by agreement). Class actions and class arbitrations are not permitted. Either party may seek injunctive relief in court for IP or unauthorized-use issues. If a court finds the arbitration/class-waiver provision unenforceable, the dispute will proceed in the state or federal courts of King County, Washington, and each party consents to jurisdiction there.

11) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. If changes are material, we may provide additional notice (e.g., posting on the Site). Your continued use after changes means you accept the updated Terms.
